DMCA Copyright Policy

TYLERROSSUSA Corporation ("we," "us," or "our") respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We provide this policy in accordance with the DMCA safe harbor provisions.

Filing a DMCA Takedown Notice

If you believe content on our platform infringes your copyright, submit a written notice containing all of the following (required by 17 U.S.C. § 512(c)(3)):

• Your physical or electronic signature (or that of an authorized agent)
• Identification of the copyrighted work you claim has been infringed
• Identification of the infringing material and its location on our platform (include the URL)
• Your contact information: name, address, telephone number, and email address
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

Our Response Process

Upon receipt of a valid DMCA notice, we will:

• Promptly remove or disable access to the allegedly infringing content
• Notify the user who posted the content of the takedown
• Provide the user with the opportunity to file a counter-notification

Counter-Notification

If you believe content was removed in error, you may submit a counter-notification containing:

• Your physical or electronic signature
• Identification of the removed content and its previous location
• A statement under penalty of perjury that you have a good faith belief the content was removed due to mistake or misidentification
• Your name, address, and telephone number
• A statement that you consent to the jurisdiction of the Federal District Court for the district in which you reside, and that you will accept service of process from the complaining party or their agent

If a valid counter-notification is received, we may restore the content after 10–14 business days unless the copyright owner files a court action.

Repeat Infringers

In accordance with the DMCA, we maintain a policy of terminating accounts of users who are repeat infringers of copyright. We reserve the right to determine, in our sole discretion, whether a user is a repeat infringer.

Misrepresentation Warning

Be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages.

Section 230 Notice

Nothing in this policy limits our rights under Section 230 of the Communications Decency Act (47 U.S.C. § 230), which provides that we are not liable as the publisher or speaker of user-generated content posted by third parties on our platform.
